Settlement

Pursuant to Section 5 of the Surface Rights Act Rules of Procedure and Practice AR 196/2007, the Board may adopt a settlement, which is defined as an agreement respecting compensation, reached by the parties to an application before the Board, as an order of the Board without holding an oral hearing.

Once a Right of Entry Order has been issued if the parties reach an agreement they may either sign a Surface Lease and request Termination of the Right of Entry Order pursuant to Section 28 of the Surface Rights Act, or request the Board to issue an Order based on their settlement agreement regarding compensation. The Board has developed a form that must be completed and signed by the parties before the Board will consider a request for an Order pursuant to Section 5 of the Regulation.
